Beavers, Weaver To File Tennessee Health Freedom Act

NASHVILLE — State Senator Mae Beavers (R-Mt. Juliet) and Representative Terri Lynn Weaver (R-Lancaster) announced today they will file legislation to protect the freedom of Tennessee patients to make their own health care choices, regardless of the federal action taken in Washington last year.

The bill is similar to legislation Beavers passed in the Senate last year.  That legislation, however, was not approved in the House of Representatives.

“The health care law passed by Congress last year is ‘big brother’ at his worst,” said Senator Beavers.  “The citizens of Tennessee believe they should be able to choose whether or not they want to participate in a federal health care plan.  That is what this bill seeks to accomplish.”

The Tennessee Health Freedom Act, does not seek to “nullify” any federal law, as it would still allow individuals the option to participate in a federal program. However, it acknowledges the right of Tennesseans to refuse to participate in a government-run health insurance program.

“The Tennessee Health Freedom Act, would protect a citizen’s right to participate, or not participate, in any healthcare system, and would prohibit the federal government from imposing fines or penalties on that person’s decision,” said Rep. Weaver.  “It seeks a remedy to fight back against the overreach of federal power on the private lives of our citizens.”

Financial experts predict that the federal healthcare plan will consume any anticipated growth in Tennessee’s revenues once the economy recovers, crippling the state’s ability to make future improvements in critical needs like education, job investment and public safety.  The federal health care law will also penalize citizens beginning in 2014 if they do not buy insurance.

“We are talking about stiff penalties that will escalate to 2.5 percent of a citizen’s taxable income by 2016 if they do not purchase health care insurance,” added Beavers.  “This will put a heavy burden on citizens who are already struggling to make ends meet.  I am very hopeful this legislation will pass our General Assembly this session.”

Another example of that bad old government funny that republicans love working for government.Only reason people are having hard time making ends meet is because wages have been cut or healthcare is to high to buy and need help .More of same old GOP bull what party or person would be against healthcare or getting help with it.

dmm48, I disagree with your assessment of this legislation, but I respect your opinion. This matter will be decided in the courts and at the voting booth, and in the end I'm confident the mandate portion of ObamaCare will be repealed.

Thank goodness we have some Senators and Representatives here in Tennessee who have the common sense and guts to stand up and say NO to the ever increasing stealing of our individual citizen rights by the Federal Government. If I want to participate in the Obama care health plan, fine, but if I choose not to, then that should be my choice and my government has no right to penelize me for making that choice.

I also agree with the financial experts who say that this ridiculous Obama health care system will bankrupt the States in a few years. This is just another plan to make the States and all American citizens totally dependent on the powers that run our Federal Government. They fear and dispise the Independent Thinking American and there are many plans afoot in all aspects of our life to destroy the independence of people who refuse to be submissive to "Big Brother"

More scare tatics from big brother gop you fund federal government every day of year.All of congress and senate have health care furnished by you at a reasonable price.If you have insurance fine if you dont there is help in this plan to help with that.Get the facts first.Republicans tried to kill social security-medicare and not one voted for health care bill,GI bill after ww2 was only passed because tie was broke by a democrat and it was passed.

Plenty of things are manadated fed income tax social security medicare and taxes on everything you purchase even property tax
and in tn automobile insurance driver license marriage hunt fish gun permit and even cannon county wheel sticker for schools so mandate is nothing new.No person in right mind would refuse help from federal government plenty farmers get farm subdisys and that is ok .Move forward are be left behind .

dmn49 no one forces you to fish, so you are not mandated to buy a fishing license.

No one forces you to get married, so you don't have to buy a marriage license.

No one forces you to buy a car, so you do not have to buy a wheel tax sticker.

Under this law, if you don't buy a FEDERALLY approved insurance policy you will be fined.

That is a mandate and not an option.

The current law also uses federal tax dollars to pay for abortions.

You need to read the Constitution because Congress does not have the power to mandate what you buy.

The only thing scary is if you use your logic of allowing Congress to mandate your life.

Why stop at insurance? Let's mandate you can't drink cola products. Let's mandate you are required to join a gym and work out three times a week. Let's mandate you can't smoke or eat products high in sodium.

All of which would greatly reduce the cost of Health Care in the United States. And all are illegal for Congress to do, just like ObamaCare.

That the system we have I live with things GOP pass and this bill will not be changed so get use to it.As far as abortion I never needed one and no business of mine between woman and her doctor.For GOP THE PARTY LINCOLN why are they so against government help. Nothing illegal about healthcare bill.Where were you people when BUSH spent 6 trillion dollars down sewer hole in Iraq or Iran contra Ollie North Reagan deal.Democrats control senate president has veto power and I think it was you that said president in office did not make a difference.Cross that bridge into 21 century.Call it what you want its the law and people will live with it.

No, people will not "live with it". That is why there have been revolutions throughout history. Some people have the guts to not be submissive to dictators. I will refuse to be mandated to buy something I can't afford at the expense of feeding or housing my self and my spouse. If the government wants to fine me so be it, I will just figure out a way to beat the system.

The word, "mandate" is abused considerably in this argument. The insinuation that all "right-minded" people will rise up and make things happen despite the results of approved methods of democracy scares the hell out of me. So are some of you out there of the mind this is worth calling your neighbors enemies? Did none of you learn anything about the recent Tucson tragedy? I am enjoying your discussion but can the intensity tone down just a bit? I feel I need to duck or something.

Jeff, revolutions can be non-violent. In fact, Dr. King, for the most part, successfully engineered one. The results of "approved methods of democracy" can also be overturned in the courts and at the voting booth. As I have stated on other threads, there are always going to be issues on which people disagree, so in that sense there will always be political "enemies."

Maybe we could get more done with just one party. Maybe that's a goal...

I will try to tone it down Jeff per your request.

I will say this. I believe all Americans need Health Care. I believe all Americans should have access to affordable Health Care. I believe all Americans should have help when it is needed and the government should be a resource when that help is asked for. I believe Americans should work and make positive contributions to society and help pay taxes to support those programs if they are capable of doing so.

I do not believe that Health Care is a RIGHT in the same way Freedom of Speech is a RIGHT. I do not believe Health Care is something that Americans should be FORCED to buy or have or pay a penalty if they do not. And I do not believe Americans should depend on the government to provide them with every single thing they need in life.

I am willing to compromise and try to find a middle ground. There was no compromise in the current Health Care Law. It was forced upon us and I believe it to be un-Constitutional.

I said all of that and never blamed a single party or person.

However, I do have to ask dmn49: Have you ever written one solution to any problem you complain about? Do you really think that the Democratic Party has no fault at all with the problems we face or even in the way the Health Care Law was forced upon us? Please answer because it is really amazing what you write sometimes.

I see you wouldn't or couldn't answer the direct questions I posed to you dmn49.

Look up at your posts, you are so anti-Republican that you can't even attempt to compromise. What a shame. That is why we face what we do today. People like yourself (in BOTH parties) need to get past the D or the R and start thinking about how to solve the issues we face.

What are your solutions? What do you propose to make things better? What are your ideas? Do something beside complain and argue.

While one Federal judge, I believe has disagreed, the judges that have found agreement with the act, pretty much sided with the finding that unless all were forced to enroll in the coverage it would seriously disrupt “the interstate healthcare marketplace by shrinking the insurance risk pool” and would, in turn drive up premiums for the insured. As it happens now the costs associated with “free care” for those without insurance, are shifted to those who are insured, direct thru their healthcare provider- you are paying that cost now.

The individual mandate is in there to address and correct these problems.


This “Nullifying” a Southern traditional going back to its heyday prior to the Civil War on the states level, is more political posturing, a sop to those who voted against the healthcare act when the ballots were cast. Much like what we are seeing on the national scene by engaging the House in a repeal vote of the Act.

Whatever gets out of there will either die in the Senate or get vetoed — it just is a message to the back home folks.

What would be useful for the House Republicans to do now, is to present to the American public what they would like to see replace the existing Act. Let all know how they would approach the problem of the 30 plus million uninsured who are now driving up costs astronomically. What is in there to assist those with pre-existing conditions and can not obtain coverage and what does one do when a condition develops and providers either jack up rates or drop coverage. Whay about Medicare Advantage providers raking in billions of profits, and coverage gap on Part D? What about dependent coverage to age 26? Let us see the whole package they will put in place when repeal has been accomplished.

People want solutions to problems–the solution is found in the bill that was passed.


Might note the public’s position on the Act has been gradually shifting and becoming more in favor with negatives going down. The run thru of a repeal is done also to re-energize the base and try to get those number going negative again.
