Lawyer Says It's Ok For Bush To Sue

Cannon County Executive Brent Bush Thursday filed a lawsuit on behalf of Cannon County against Pemberton Trucking for breach of contract and damages for allegedly not following through on specific terms of agreement.
Since the filing a few of the county commissioners have not been happy that they weren't given advance notice of the lawsuit. In addition some are questioning why County Attorney is not handling the case. County attorney Chris Coats has outsourced the case to another firm out of Smyrna. He has not given any reasons to the commissioners as to why this was not handled by himself.
In a email to the commissioners, Coats does address the question of whether or not Executive Bush had the right to file the lawsuit.
According to Coats, the original contract was signed in 2013 by Mike Gannon who was the county mayor at the time. Since Brent has been elected to that position, the rights and responsibility for the contract are with his office. Because the commissioners' signatures are absent on the contract, it is the county mayor's responsibility.
In Coats opinion, this is a valid lawsuit to recoup losses where the contract was not followed.
Coats challenges the commission in the email to let him know the Tennessee Code Annotated that anyone feels Brent had violated and Coats will research it.
The Commission meets Thursday February 6th for their regular monthly meeting in the Courtroom of the Cannon County Courthouse.
